Independent Authorities

ADR assists its Clients in their relationships with Independent Authorities (AGCM, ANAC …). Knowing the rules and managing an anti-trust procedure, adopting compliance programs, getting the Rating di Legalità (a type of ethical rating for Italian companies), effectively implementing self-cleaning measures, reporting anti-competitive practices: they are just few examples of the numerous activities that must be implemented to stay competitive on the market.

Here are some advisory services successfully performed by ADR for its Clients in the area of Independent Authorities:

  • ADR organized a team of defence lawyers to protect a Client in an antitrust inspection procedure.

  • ADR took care of the preparation and effective implementation of a compliance programme for the Client Company. As a result, the penalty was reduced for an amount of 1,150,000.00 euros.

  • ADR planned and implemented specific self-cleaning measures for a Client in order to enable the company to participate in a tender process, even though the company had been fined by the Antitrust Authority. The company successfully participated in the tender process.

  • ADR planned and implemented specific self-cleaning measures for a Client in order to enable the company to participate in a tender process, although the business owner had been convicted for a crime relating to workplace safety. The company successfully participated in the procedure.

  • ADR assisted a listed Client Company at AGCM (Competition and Market Authority) in obtaining the Rating di Legalità(a type of ethical rating for Italian companies). The Company successfully achieved the target, scoring two stars and two pluses.

  • ADR took care of the preparation and effective implementation of a privacy-related compliance programme, also in view of the new Regulation (EU) 2016/679 (General Data Protection Regulation).

  • ADR assisted a Client at ANAC (National Anti-corruption Authority) in bringing a complaint to contest the assumption that the participant was not providing the service in accordance with the specifications guaranteed in the tender put forward during the procurement process.

ADR organizes training sessions to enable the Company’s managerial staff and employees to manage the above mentioned activities on their own and in the best possible way.
